Privacy & Data Protection Policy

Effective as of October 4, 2026. Applies to all agency interactions, store purchases, and digital agreements.

1. Data Controller Identification

The data controller responsible for the personal information processed through cesarbusinesslab.com is Cesar Business Lab, founded and operated by Cesar Pinto. Direct privacy inquiries can be directed to: contact@cesarbusinesslab.com.

We adhere strictly to principles of data minimization, lawful processing, purpose limitation, integrity, and strict confidentiality across all user interactions.

2. Categories of Information We Collect

We collect only the minimum data essential to provide high-velocity agency services, process digital transactions, and maintain technical infrastructure:

2.1. Information Provided Directly by You

• Contact & Inquiry Forms: Name, email address, company name, requested service discipline, estimated budget bracket, and project brief details.

• Store Checkout Details: Customer email address (used for automated delivery of download links and license receipts), full name, and billing country.

• Client Communications: Asynchronous messages, briefs, and emails exchanged for project execution.

2.2. Automatically Collected Technical Data

• Technical Logs: Anonymized IP addresses, browser user-agent, operating system, and timestamp logs strictly required for security mitigation (DDoS defense).

• Client-Side Storage (localStorage): Items placed into your shopping cart are saved locally in your own browser ('cbl_cart_items') to ensure persistence across page navigation without tracking user identities.

3. Purposes & Legal Bases for Processing

We process personal data solely under the following recognized legal grounds:

1. Contractual Necessity: Processing orders, delivering downloadable digital assets, issuing commercial invoices, and executing contracted marketing or development sprints.

2. Explicit Consent: Responding to inquiries, quote requests, and communications submitted through our contact forms.

3. Legitimate Interests: Defending against payment fraud, mitigating automated spam, ensuring web application uptime, and monitoring technical performance.

4. Legal & Regulatory Compliance: Retaining mandatory accounting, tax, and invoicing records as required by fiscal authorities.

4. Third-Party Service Providers & Subprocessors

WE DO NOT SELL, RENT, OR TRADE YOUR PERSONAL DATA TO THIRD PARTIES FOR ADVERTISING OR MONETIZATION PURPOSES UNDER ANY CIRCUMSTANCES.

We share data exclusively with trusted, SOC-2 / PCI-DSS certified subprocessors necessary for platform operations:

4.1. Verified Cloud & Banking Infrastructure

• Stripe Inc.: Banking-grade payment processing with tokenized 256-bit encryption. Stripe processes payment credentials under its own privacy policy.

• PayPal Holdings Inc.: Secure checkout processing for PayPal account holders.

• Vercel Inc. / Cloud Hosting: Enterprise edge infrastructure, secure SSL/TLS certificate termination, and global CDN delivery.

• Transactional Email Providers: Automated infrastructure used exclusively to dispatch order receipts and verified download links.

5. Data Retention & Information Security

We retain personal data only for the period necessary to fulfill the purposes for which it was gathered, or to comply with statutory fiscal and accounting obligations.

We enforce robust technical safeguards across our entire architecture: mandatory HTTPS/TLS 1.3 encryption, secure HTTP security headers (HSTS, CSP), tokenized API authentication, and zero persistent storage of sensitive payment credentials.

6. Your Privacy Rights (GDPR, CCPA & Global Protections)

Under international privacy regulations (including European GDPR and California CCPA), you are entitled to exercise the following rights regarding your personal information:

• Right of Access: Request verification and receive a portable copy of the personal data we hold about you.

• Right to Rectification: Request correction of inaccurate, outdated, or incomplete records.

• Right to Erasure ('Right to be Forgotten'): Request permanent deletion of your personal data when no longer needed for contracted purposes or legal retention.

• Right to Restriction & Objection: Object to or restrict specific processing activities.

• Right to Non-Discrimination: We never deny services, alter prices, or diminish quality if you choose to exercise your privacy rights.

To exercise any of these rights, email your request to contact@cesarbusinesslab.com. We respond to all verified requests within 30 business days.

7. Minors & External Web Links

Our website and services are intended exclusively for commercial entities and individuals aged 18 and older. We do not knowingly collect personal data from minors. If we discover inadvertent collection of data from a minor, it is permanently deleted immediately.

Our website contains links to external platforms (LinkedIn, YouTube, Upwork). Cesar Business Lab does not govern and is not responsible for the privacy practices of external third-party sites.
